All content, designs, graphics, and intellectual property created by Gold Gorilla Digital Design during your project are the property of Gold Gorilla Digital Design until final payment has been received. Upon full payment, ownership of project deliverables is transferred to the client. We retain the right to use our work for portfolio and marketing purposes unless expressly prohibited by a signed confidentiality agreement.
Clients are responsible for providing accurate, complete information and any materials needed for project completion, including text, images, and other content. Clients also agree to be responsive to feedback requests, approvals, and project milestones to ensure timely project progress.
Payment terms will be outlined in your project proposal or contract. Generally, a deposit is required to begin work, with remaining payments due as specified in your agreement. Failure to make payments as agreed may result in project delays or suspension.
Due to the custom nature of our services, refunds are generally not provided once work has commenced. If a project is canceled, any fees paid to date are non-refundable, and additional charges may apply to cover work completed. We are committed to delivering high-quality services and will work with clients to address any concerns.
Each project includes a set number of revisions, as outlined in the project proposal. Additional revisions or changes to the original project scope may incur additional fees. Clients will be notified of any additional costs before changes are implemented.
Gold Gorilla Digital Design will provide an estimated timeline for each project. Timelines are subject to client cooperation and availability and may be adjusted due to unforeseen circumstances. We will communicate any changes to timelines in a timely manner.
We respect the confidentiality of all client information provided to us and agree not to disclose it to third parties without permission. This does not apply to information already in the public domain or if disclosure is required by law.
Gold Gorilla Digital Design will make every effort to ensure that all deliverables meet industry standards and are free of errors. However, we do not guarantee the performance or functionality of third-party services or integrations used within projects. Our liability is limited to the fees paid by the client for our services, and we shall not be liable for any indirect, incidental, or consequential damages.
You agree to indemnify and hold harmless Gold Gorilla Digital Design, its employees, contractors, and agents from any claims, damages, losses, or expenses arising out of or in connection with your use of our services, any project deliverables, or breach of these Terms and Conditions.
Our services may incorporate third-party tools, plugins, or APIs. Gold Gorilla Digital Design is not responsible for the performance, availability, or reliability of these third-party services, and any use is subject to the terms of the third-party providers.
Either party may terminate the project upon written notice. Upon termination, the client is responsible for paying for any completed work up to the date of termination. Gold Gorilla Digital Design reserves the right to retain ownership of deliverables until all outstanding fees are paid.
Gold Gorilla Digital Design reserves the right to modify these Terms and Conditions at any time. Any updates will be posted on our website with the “Last Updated” date, and continued use of our services constitutes acceptance of the modified terms.
